01Agreement
These terms apply to your use of racktrack.ai (the "website"), operated by RackTrack Inc., 85 Felt Rd, Suite #604, South Windsor, CT 06074, USA. By using the website you agree to them. If you use it on behalf of an organisation, you confirm you may accept these terms for it.
02The website and the platform
The RackTrack platform, including portal.racktrack.ai, the capture app and any evaluation or pilot, is provided only under a separate written agreement between RackTrack and the customer organisation. If that agreement conflicts with these terms, the agreement wins for the platform.
03Using the website
You may browse, read and share links to the website for lawful purposes. You agree not to:
- interfere with the website's operation or security, or try to gain unauthorised access to it, the platform or related systems;
- use automated means to copy large parts of the website, or to collect information about other people;
- use the website to send unlawful, harmful or misleading material;
- suggest that RackTrack endorses you or your products, or misuse our name, logo or trademarks.
04Our content and intellectual property
The website and its content, including text, graphics, 3D scenes, code, the RackTrack name and logo, are owned by RackTrack Inc. or its licensors and protected by intellectual property laws. RackTrack's platform is the subject of pending patent filings (US Application 19/219,347).
You may quote short passages from our articles with attribution and a link to the source page. Any other copying, adaptation or redistribution needs our written permission. Nothing on the website grants you a licence to our patents, trademarks or software.
05Illustrative scenes and figures
Much of the website uses 3D scenes and example data to explain how RackTrack works. Rack names, device names, serial numbers, port numbers, counts such as "12 of 14 matched", and other values marked illustrative or example are made up for demonstration. They do not describe any real customer, site or result.
Statistics presented as research findings are attributed where they appear. Actual results depend on each environment, and product features, timings and deployment options can change.
06No professional advice
Articles, resources and other content are general information about infrastructure operations. They are not legal, compliance, audit, security or financial advice, and you should not rely on them as such. Get advice suited to your circumstances before making decisions.
07Enquiries, demos and assessments
Sending a brief or enquiry does not create a contract or oblige either party to anything. Any evaluation, baseline assessment, pilot or purchase happens under terms we agree in writing. How we handle the information you send is described in the Privacy policy.
08Third-party links and services
The website links to other sites, such as LinkedIn, Instagram and Facebook, and uses a few providers to deliver pages, typefaces and its 3D library (listed on Third-party services). We are not responsible for other sites' content or practices. Their own terms and policies apply when you use them.
09Disclaimer
The website is provided "as is" and "as available". To the fullest extent the law allows, RackTrack disclaims all warranties about the website, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement. We do not promise that the website will always be available, uninterrupted or free of errors.
10Limitation of liability
To the fullest extent the law allows, RackTrack will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the website. Our total liability for any claim relating to the website is limited to one hundred US dollars (USD 100).
Nothing in these terms limits liability that cannot be limited by law. Where you use the website as a consumer, your mandatory legal rights are not affected.
11Changes and availability
We may change the website or these terms at any time. The date at the top shows the current version, and continuing to use the website after a change means you accept the updated terms. We may suspend or withdraw any part of the website without notice.
12Governing law
These terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Connecticut have exclusive jurisdiction over disputes about the website, unless the law where you live gives you the right to bring proceedings there.
If any part of these terms is found unenforceable, the rest stays in effect.
